Terms of Use

The rules for accounts, academy content, paid features, and responsible use.

1. Who provides the academy

DigixData Learning is provided by DigixData Inc., a Texas corporation, at 11625 Custer Road, Suite 110-161, Frisco, TX 75035 (called “DigixData,” “we,” or “us” below). These terms apply when you visit the academy, create an account, enroll, submit work, use Module Mentor, or buy a paid offering.

By using the academy, you agree to these terms. If you cannot enter a binding agreement where you live, do not use the paid features without a parent, guardian, or other authorized person.

2. Your account

Sign-in uses an email link. Give us an email address you control, keep sign-in links private, and tell us promptly if you think someone else used your account. You are responsible for activity under your account unless applicable law says otherwise.

3. Learning and AI features

Course lessons are educational. Paid-tier artifact grading and Module Mentor chat use third-party AI services. AI output can be incomplete or wrong, so you must review it and make your own decisions. The academy does not provide legal, medical, financial, employment, or other professional advice.

Do not submit secrets, passwords, payment-card data, regulated records, or other information you are not authorized to share. See our Privacy Notice for the AI-processing disclosure.

4. Acceptable use

You may not use the academy to:

  • break the law, violate another person’s rights, or submit material you do not have permission to use;
  • probe, disrupt, overload, bypass, scrape, or reverse engineer the service or its access controls;
  • share paid access, impersonate someone, or interfere with another learner;
  • upload malware or use academy features to harm people or systems.

5. Academy content and your submissions

DigixData and its licensors keep their rights in the lessons, software, branding, templates, and other academy materials. Unless a resource says otherwise, your access is personal and may not be resold or redistributed.

You keep ownership of work you submit. You give us a limited permission to host, process, reproduce, and transmit that work only as needed to operate the academy, provide feedback, support you, keep the service secure, and meet legal obligations. We do not display your submitted work publicly, in marketing, or as a testimonial without your separate written permission, and this permission ends when you delete your account, except for copies we must keep for security, dispute, or legal reasons.

6. Purchases and refunds

Prices and what is included are shown before checkout. Payments are handled by Stripe. Paid access begins only after payment is confirmed. Our 14-day refund window is explained in the Refund Policy. Nothing in that policy removes a right that cannot be waived under the law that applies to you.

7. Availability, changes, and ending access

We may maintain, improve, replace, or discontinue features. We will try to give reasonable notice when a material change affects paid access, but the service may occasionally be unavailable. We may suspend or end access for a serious or repeated breach of these terms, a security threat, or a legal requirement.

8. Disclaimers and responsibility

The academy is provided on an “as available” basis. We do not promise that every lesson, AI response, grade, certificate, or feature will be error-free or fit every learner’s situation. Nothing here removes a warranty, remedy, or responsibility that applicable law does not allow us to exclude.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the academy in any twelve-month period is limited to the greater of the amount you paid us in that period and fifty US dollars. To the same extent, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. These limits do not apply where the law does not allow them, including liability for willful misconduct or gross negligence, and they do not remove a consumer right that cannot be waived.

9. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any court proceeding must be brought in the state or federal courts located in Collin County, Texas, except where consumer law gives you the right to proceed elsewhere. Before filing a claim, you agree to email support@digixdata.com and give us thirty days to work toward an informal resolution. These terms do not include an arbitration clause, and nothing here waives your right to bring an individual claim in small-claims court.
